PIR Privacy Policy
This Policy outlines the obligations which Property Investment Research Pty Ltd (PIR) has in managing the personal information we hold about our clients, potential clients, contractors and others.

PIR is bound by the National Privacy Principles (NPPs) contained in the Privacy Act 1988 (Cth) (Privacy Act).

In summary, "personal information" is information or an opinion relating to an individual which can be used to identify that individual.

PIR collects personal information in order to conduct its business, to provide and market its services and to meet its legal obligations. In most cases, if personal information that PIR requests is not provided, PIR may not be able to supply the relevant product or service.

The type of information PIR may collect and hold includes (but is not limited to) personal information about:
  • clients;
  • business associates;
  • potential clients and their employees;
  • suppliers and their employees;
  • prospective employees, employees and contractors; and
  • other people who come into contact with PIR.
In general, the type of personal information PIR collects and holds includes (but is not limited to):
  • names;
  • addresses;
  • contact details;
  • occupations; and
  • other information which assists PIR in conducting its business, providing and marketing its services and meeting its legal obligations.
While unlikely, some personal information collected may be "sensitive information". Sensitive information includes: information relating to a person's racial or ethnic origin, political opinions, religion, trade union or other professional or trade association membership, sexual preferences and criminal record. Sensitive information will be used and disclosed only for the purpose for which it was provided or a directly related secondary purpose, unless the provider agrees otherwise, or where certain other limited circumstances apply (e.g., where required by law).

PIR will generally collect personal information by way of:
  • completed forms;
  • face-to-face meetings;
  • interviews;
  • business cards
  • telephone conversations; and
  • for third parties
PIR collects personal information from the web site www.pir.com.au through receiving subscription applications and emails. PIR may also use third parties to analyse traffic at that web site, which may involve the use of cookies which may capture information such as server address, domain name, date and time of visit, previous site visited and browser type.

In some circumstances PIR may be provided with personal information about an individual from a third party or a reference from another person. Personal information from these organisations and individuals is dealt with in accordance with this Policy.

PIR may use and disclose personal information for the primary purpose for which it is collected, for reasonably expected secondary purposes which are related to the primary purpose and in other circumstances authorised by the Privacy Act.

In general, PIR uses and discloses your personal information for the following purposes:
  • to conduct its business;
  • to provide and market its services;
  • to communicate with clients, subscribers, organisations and others;
  • to purchase from organisations;
  • to comply with its legal obligations; and
  • to help manage and enhance its services.
PIR may disclose your personal information to:
  • other members of the PIR Group and any associated offices;
  • other companies or individuals who assist PIR in providing services or who perform functions on its behalf (such as mailing houses or specialist consultants);
  • courts, tribunals and regulatory authorities; and
  • anyone else to whom the provider authorises PIR to disclose it.
PIR will use reasonable endeavours to prevent the disclosure of the information, except to the extent:
  • indicated at the time of supply of the information;
  • expressly permitted under any agreement;
  • required for performance by PIR of services to the provider;
  • required for the ordinary operation of the PIR website or business (eg to distribute information about PIR services);
  • required under compulsion of law or provided in cooperation with any governmental authority;
  • or where it is already publicly available or is disclosed by PIR in a manner that does not readily permit identification of information relating to the provider.
Subject to the above overriding prohibition on disclosure, PIR may use the information as it sees fit for the purposes of its business.

PIR will endeavour to not send personal information to recipients outside of Australia without:
  • obtaining the providers' consent (in some cases this consent will be implied); or
  • otherwise complying with the NPPs.
The NPPs requires PIR to take reasonable steps to protect the security of personal information. PIR personnel are required to respect the confidentiality of personal information and the privacy of individuals. PIR takes reasonable steps to protect personal information held from misuse and loss and from unauthorised access, modification or disclosure, for example by use of physical security and restricted access to electronic records.

Where PIR no longer requires personal information for a permitted purpose under the NPPs, PIR will take reasonable steps to destroy it.

PIR endeavours to ensure that the personal information it holds is accurate, complete and up-to-date. Providers are encouraged to contact PIR in order to update any personal information held about you.

Subject to the exceptions set out in the Privacy Act, any provider may gain access to the personal information which PIR holds about that person by contacting PIR.

PIR will require you to verify your identity and to specify what information is required. A fee may be charged for providing access, the likely quantum of which will be advised in advance.

This Policy will be reviewed from time to time to take account of new laws and technology, changes to operations and practices and the changing business environment.

  • From time to time the PIR website may contain links to other websites. PIR is not responsible for the privacy practices or the content of those websites.
  • Although PIR has implemented security measures in relation to the information, as the website is linked to the internet and the internet is inherently insecure, PIR cannot provide any absolute assurance regarding security of the information. PIR will not be liable in any way in relation to any breach of security or unintended loss or disclosure of information due to the website being linked to the internet.
  • PIR accepts no responsibility for unauthorised use of any password or other security mechanism provided, other than by PIR staff.
  • This website privacy policy is subject to amendment at any time. Any amendment will be made on a prospective basis, i.e. all information received or retained before the time of any amendment will remain subject to the policy applicable before the amendment.
